Feasibility study of Regulatory Regime for Industry, Commerce and Trade in FATA
With financial and technical support from the FATA Development Authority (FDA), CAMP initiated a research study related to existing laws and regulations on Commerce, Trade, Industry, Service sector and Labour in March 2010.
Currently the tribal areas have no primary laws relating to starting business, property rights, contracts, getting credit, collateral, mortgage, insurance, employing workers and a other related laws that apply to the rest of Pakistan due to its non extension, thus creating a legal void. The absence of legal cover not only makes investment highly risky but serves as a disincentive in general and particularly for large firms.
In order to fill the legal void with the objective of providing enabling business environment particularly for the upcoming Reconstruction Opportunity Zones (ROZs) in FATA, CAMP is conducting a detailed study of all existing laws in vogue regarding start, operation and regulations of Commerce, Trade industry and investment. The outcome of this study will propose a mechanism for placement/extension of these Laws & Regulations or alternatively propose statutory amendments in the existing legal & administrative set up in the FATA. The study is also intended to result in proposing an institutional arrangement that will be tasked to enact and enforce these laws and regulations.
Besides reviewing existing laws, CAMP will hold interactive workshops and Focus Group Discussions (FGD) with support from FDA. The participants will include a wide range of stakeholders including industrialists, traders, businessmen, both the Tribal and Sarhad Chambers of Commerce & Industries, Bars/Legal Community, political/law enforcing administration/FATA Secretariat, FATA legislators and journalist etc. Apart from creating awareness and disseminating the benefits of Regulatory Regime, these sessions will allay fears, misgivings & apprehensions to evolve consensus with a view to determine and adjudge the acceptability, practicability and feasibility of setting up a Regulatory Regime in FATA or otherwise.
